You acknowledge that individual results will vary and that you are solely responsible for how you implement any strategies, guidance, or educational materials provided through the Site or Offerings.

19. No Professional Advice

The Site and all Offerings are for educational and informational purposes only.

Nothing on the Site or in any Offering constitutes legal, tax, accounting, financial, investment, therapeutic, or other professional advice. 21. Release and California Civil Code Section 1542 Waiver

If applicable, you expressly waive the protections of California Civil Code Section 1542, which states:

• your violation of these Terms,

• your violation of any law or third-party rights,

• your User Content,

• your business activities, marketing claims, products, or services.

23. Limitation of Liability

To the fullest extent permitted by law, First Drop Studio and Core Element Group LLC will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of revenue, profits, business opportunity, goodwill, data, or other intangible losses arising out of or relating to your use of the Site, Content, or Offerings.

Our total cumulative liability for any claim arising out of or relating to these Terms, the Site, or any Offering will not exceed the greater of:

1. $100, or

2. the amount you paid to us for the specific Offering giving rise to the claim within the one (1) month preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

26. Dispute Resolution and Arbitration

The arbitration will be conducted before a single neutral arbitrator in English. Unless otherwise required by law, the arbitration will take place in Riverside County, California, or another location selected by First Drop Studio in its reasonable discretion. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Each party will bear its own legal fees and costs unless the arbitrator awards otherwise under applicable law or these Terms.

Nothing in this section prevents either party from seeking temporary or injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

27. Class Action Waiver and Jury Trial Waiver

To the fullest extent permitted by law, you agree that any dispute will be brought only in your individual capacity and not as a plaintiff or class member in any class, consolidated, representative, or collective proceeding.

You and First Drop Studio also knowingly and voluntarily waive any right to a jury trial for any dispute arising from these Terms, the Site, or any Offerings.

28. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles, except where federal law applies.

Subject to the arbitration requirements above, any legal action permitted to proceed in court shall be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction and venue of those courts.

29. Time Limit to Bring Claims

To the extent permitted by law, any claim arising out of or relating to the Site, these Terms, or any Offering must be brought within one (1) year after the claim arises, or it will be permanently barred.

30. Force Majeure

We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, power failures, internet outages, pandemics, labor disruptions, acts of government, war, terrorism, or similar events.

31. Privacy

Your use of the Site is also subject to our Privacy Policy. By using the Site, you consent to the collection, use, and disclosure of information as described in our Privacy Policy.

1. General Policy

Due to the immediate access, transfer of knowledge, downloadable resources, digital delivery, scheduling commitments, and the nature of consulting services, we do not offer refunds for:

2. Digital Products and Downloadable Resources

3. Courses, Programs, and Paid Content Access

4. Discovery Calls, Consultations, and Strategy Sessions

If proper notice is given, we may allow a one-time reschedule at our discretion. Missed calls, late arrivals, and no-shows are non-refundable.

If you arrive late, your session may still end at the originally scheduled time.

5. Payment Plans

If a payment plan is offered, you are responsible for completing all scheduled payments unless otherwise agreed in writing.

Choosing not to continue, not participate, or not use the purchased Offering does not cancel your payment obligation.

Failure to complete payments may result in suspension or termination of access to the applicable content, program, or service.

6. Chargebacks and Payment Disputes

By making a purchase, you agree not to initiate a chargeback or payment dispute without first contacting us at launch@firstdropstudio.com to attempt resolution.

If a chargeback is initiated for a valid charge, we reserve the right to:
